It is the Policy of Mingo Gold/MASI to perform its work and services in the safest manner possible. The Company Safety and Health Program is the responsibility of all employees. All work shall be consistent with good safety practices and according to all laws and regulations. The safety and health of our employees and the public is forefront in our core values.
The Company Safety and Health Program may be revised from time to time. This Program is not a one-time plan, but is a dynamic program that is always being improved. It is your responsibility to take note of Safety and Health Program changes and modifications.
The “Safety and Health Program” contains the Company safety and health policies and rules for our workplaces. They represent a wealth of practical experience, and have been tested over time.
Failure to follow Company Safety and Health guidelines may lead to immediate termination. Therefore, as a condition of employment with COMPANY NAME, each employee is required to study, understand and abide by these protocols.
This Safety and Health Program is provided for the sole purpose of improving safety and health conditions in our Company and workplaces, and is NOT to be considered an agreement or contract of employment.
Our Safety and Health Program is designed to follow the guidelines required by OSHA. These guidelines require the Company to develop, implement and maintain a program of policies, procedures, practices, and trainings that are adequate to protect our employees and the public from safety and health hazards. Our program provides ways to systematically identify, evaluate, and prevent or control workplace hazards, specific task hazards, and hazards which could arise from operations.
The Company believes that most accidents are preventable, and that it is the responsibility of each and every employee to ensure that we practice safety as a routine part of our daily work. Our primary safety goal is that no one becomes injured at our workplaces.
Safety is a top priority. We believe a safety and health program will effectively eliminate or control work related hazards faced by company employees. The success of this safety program hinges on clearly stated work rules, regularly scheduled and informative safety and training meetings, a thorough self-auditing program, and the assistance and cooperation of all employees. All employees must follow the standards and company work rules. A progressive disciplinary policy will be enforced as part of this program.
ADHERENCE TO THE SAFETY AND HEALTH PROGRAM SHOULD MINIMIZE THE RISK OF INJURY.
RESPONSIBILITY FOR SAFETY
Everyone working in the operation is responsible for safety. Everyone must take the obligation seriously. Unsafe work practices, acts or conditions will not be tolerated. Safety is never to be compromised to production or product.
In order for the company to provide safe and healthful employment, everyone must:
- Comply with all federal, state and local laws and regulations
- Use good judgment and safe practices on all jobs;
- Comply with the company Safety and Health Program and Work Rules
The Company is specifically responsible for:
- Fostering a work environment where safety and health are paramount
- Ensuring that employees are afforded the training necessary to maintain a safe and healthful work site
- Implementation of the company’s safety and health program
- Monitoring and requiring compliance with the company Safety and Health program, Work Rules and OSHA standards
- Providing necessary personal protective equipment
- Ensuring that supplies and equipment purchased by the company comply with safety standards
- Ensuring that equipment provided by employees complies with OSHA safety standards and company safety standards and work rules
- Maintaining records of employee training and as required by OSHA
Supervisors are specifically responsible for:
- Monitoring and requiring compliance with company Safety and Health Program, Work Rules and OSHA standards
- Ensuring that proper safety equipment is available and used appropriately
- Conducting job-site inspections, safety meetings, training and supervision, as needed, during work hours
- Correcting hazards and unsafe practices
- Obtaining medical attention for injured employees as quickly as possible and initiating First Responder intervention and Emergency Evacuation Procedures, as appropriate
Employees are specifically responsible for:
- Complying with all safety and health standards and regulations
- Complying with all company work rules
- Actively participating in safety and health training
- Requesting assistance and supervision as needed
- Using and maintaining all owned equipment in accordance with OSHA safety standards, company safety standards and company work rules
- Using and maintaining personal protective equipment
- Reporting all observed unsafe acts, practices or conditions
- Correcting unsafe acts, practices or conditions within their immediate work area
Safety and Health Consultants and Insurance Safety Advisor: The Company may retain the services of a safety and health consultant and/or insurance safety advisor. The individuals shall visit the company workplace for at least one full day per month, during which time they shall conduct on-site inspection of operations, conduct a safety meeting and be available for consultation with employees. These individuals shall also meet with the owner/operator, foreman, and supervisors to review workplace safety and health issues, including all written reports.
Written reports made by these individuals will be maintained in the company files.
The company shall neither request nor permit an employee to begin work, or to begin a new task within the company, until the employee has been oriented to the job and has demonstrated the skill and work techniques necessary to do the job safely.
Each employee shall receive a personal copy of the safety and health program; a personal copy of the OSHA safety standards applicable to their work activities; and a personal copy of the work rules. The copies will be in the employee’s native language.
Each employee shall be required to read each of these documents, and those employees who cannot read shall have the documents read to them. Each employee shall also receive detailed verbal explanation of the company safety and health program, all safety standards and work rules before commencing work.
All employees will have the opportunity to ask questions and receive:
- A detailed description of the job tasks assigned and the proper techniques for performing them
- Detailed instruction on the proper use and maintenance of personal protective equipment
- Training for identification of hazards and corresponding safety standards and work rules
- On-site inspection to ensure technical competence and safety awareness, the determination of competence and awareness shall be made by the foreman and safety director in consultation
The employer shall provide training for each employee, including supervisors, at no cost to the employee.
Training shall be provided as follows:
- As soon as possible for initial training for each current and new employee
- Prior to initial assignment for each new employee
- Whenever the employee is assigned new work tasks, tools, equipment, machines or vehicles
- Whenever an employee demonstrates unsafe job performance
At a minimum, training shall consist of the following elements:
- Safe performance of assigned work tasks
- Safe use, operation and maintenance of tools, machines and vehicles which the employee uses or operates, including emphasis on understanding and following the manufacturer’s operating and maintenance instructions, warnings and precautions
- Recognition of safety and health hazards associated with the employee’s specific work tasks, including the use of measures and work practices to prevent or control those hazards
- Recognition, prevention and control of other safety and health hazards in the Industry
- Procedures, practices and requirements of the employer’s work site
The employer shall train each current and new employee in those elements for which the employee has not received training.
The employer is responsible for ensuring that each current and new employee can properly and safely perform the work tasks and operate the tools, equipment, machines, and vehicles used in their job.
The company shall employ only certified professionals as operators. Any such employee who is not so certified at the time of hire must obtain certification within one year of the date of hire.
The company shall provide training to employees at the time of their initial hire and at least annually thereafter. Training will also be provided whenever a change in job assignment will expose the employee to new hazards. This training shall occur before the employee starts the work for which the training is required.
At a minimum, employees shall be trained to recognize safety hazards associated with their individual work tasks, and the preventive and protective measures to deal with such hazards. The training provided by the company shall also give employees the information necessary to recognize and control safety hazards in the generally.
Employees shall demonstrate the ability to perform the tasks of their job.
All new and inexperienced employees and current employees unfamiliar with a new assignment shall be under the close guidance of the owner/operator or a supervisor until it is determined by the owner/operator or supervisor that those employees are able to work in a safe manner.
The success of any accident prevention program depends on the cooperation and active support of all employees as well as the owner/operator.
A safety Officer shall be hired at each operation. A safety Officer facilitates employee participation in the safety program and hazard identification. The safety committee shall include the owner/operator, one employee from each job classification (e.g. laborer, operator, etc.), foreman and a supervisor.
The safety Officer shall review accident investigation reports, and may make recommendations on eliminating unsafe conditions and practices. The Officer may also recommend safety standards, work rules and training.
SAFETY STANDARD AND WORK RULE ENFORCEMENT
Compliance with safety standards, the safety and health program and work rules is a condition of employment.
An employee who fails to comply with safety standards or work rules shall be disciplined as follows:
- First Violation: Verbal warning to the employee, along with instruction explaining the violation.
- Second Violation: Written warning explaining the violation. The employee’s supervisor and the owner/operator shall counsel the employee in an effort to avoid a reoccurrence of the same or a similar violation.
- Third Violation: Suspension for one (1) week. A counseling meeting will be held with the employee, the owner/operator and the employee’s supervisor. The employee shall submit a written statement demonstrating understanding of the safety standard or work rule violated, as well as what the employee intends to do in the future to ensure compliance. The written statement must be provided to the company before the employee will be allowed to commence work again.
- Fourth Violation: Termination.
Flagrant, egregious or intentional violations of a safety standard or work rule may result in immediate termination.
The progressive disciplinary policy established by the Safety and Health Program does not alter or limit the company’s right to terminate the employment relationship at any time for any reason. All employees are employees at will.
A written record, dated and signed by the employee, the employee’s supervisor and the safety director shall be prepared and maintained for each violation of a safety standard or work rule.
REPORTING UNSAFE ACTS, CONDITIONS AND SIGNIFICANT NEAR MISSES
All observed unsafe acts, conditions and near misses must be reported to the owner/operator, foreman or supervisor. Failure to report such incidents or conditions results in the loss of valuable information that could prevent a serious accident or property damage in the future.
Investigations shall be conducted in accordance with the provisions of this safety and health program.
OSHA safety standards provide the basic safety requirements. Hazard identification is a continuous process, however, and all employees, supervisors and management must watch for and correct unsafe conditions. Safety standards and work rules shall be expanded as needed in accordance with ongoing hazard identification.
The company shall conduct on-site inspections, records reviews and accident investigations as part of its hazard identification program. The company believes that employee feedback on existing safety standards and work rules is important, and such feedback is encouraged.
Modification or deletion of a company safety standard or work rule shall be made only after consultation with a safety consultant.
The company shall conduct on-site inspections of its operations. On-site inspections will be conducted twice weekly by the owner/operator, foreman or supervisor.
The purpose of these inspections is to ensure compliance with OSHA safety standards, company safety standards, and company work rules.
When conducting inspections, the owner/operator, foreman, or supervisor shall identify hazards and problems at the work site to ensure that existing safety standards and work rules are adequate to ensure a safe work site.
Inspections will include a work site review, personal protective equipment review, review of the skill and technique of each employee and an equipment/machine review. The checklist attached hereto shall be used as a guide when conducting on-site inspections.
A written report of on-site inspections shall be made. In addition, each employee will be provided with a report of the inspection of his work activity. These records shall be maintained by the employer.
The Company has Safety & Health Guidelines to establish safety rules. Specific guidelines apply for specific work activities like equipment, confined spaces, welding, excavating and trenching, etc. See the appropriate specific guidelines for work activities not covered by this document. Violation of any Company Safety and Health rules, guidelines, procedures, or instructions are cause for warning, reprimand, suspension, and termination of employment. Violations of prohibited activities may result in immediate employment termination.
An effective, proactive safety and health program will seek to identify and analyze all hazards.
Workplace analysis describes how management will collect information on current and potential hazards. It consists of a literature review, identification of hazard categories, workplace surveys, and an analysis of trends. The purpose of a workplace analysis is to recognize existing and potential hazards, to identify employees at risk, and to establish and subsequently to evaluate the control measures. The multi-disciplinary team should conduct the workplace analysis.
Initially, the workplace analysis will establish a baseline. Then it must become a continuous and ongoing process to recognize, identify, and control occupational hazards. The frequency of workplace analyses depends on the specific characteristics of the hazards and the work environment.
The workplace analysis may be performed on a specific area or problem or it may be done on a regularly scheduled basis in an area where a hazard has been identified. Workplace analyses also should be conducted when there are changes in procedures, equipment, or processes.
This is an important part of your safety program. Several tools have been included to help you. Use this section to summarize the results of your analysis. Following are some general hazards and precautions applicable to almost all workplaces. Add sections to the safety handbook which apply to specific hazards in your workplace
Eye Protection shall be worn when using tools or chemical hazards that may cause possible eye injury.
Firearms and Explosives
As clearly described in the Codes of Conduct policies located in the employee handbook, Firearms and explosives are prohibited on all company worksite. This does not include approved and supervised explosion-activated tools.
Hard hats shall be worn at all times in construction zones.
High Temperature Substances and Fluids
When near molten substances or high temperature fluids all persons nearby are to wear appropriate personal protective equipment. When pouring high temperature fluids, the pour area must be completely dry and free from moisture of any kind to avoid splattering and possible explosion.
Make sure you are knowledgeable and know how to do your work activities in a safe manner and can identify hazards in your work area. Ask your supervisor if you are not sure.
Lifting and Carrying
Employees are required to practice safe lifting techniques. Safe lifting technique includes using the proper lifting methods every time you lift or move something. The following guidelines will help avoid any unnecessary strain:
- Plan the move in advance.
- Decide on the safest route.
- Move all obstacles and trip hazards.
- Ensure the destination is clear and will safely support the load.
- Get help or use special equipment when moving heavy or large objects.
- Stand close to the object with your feet apart.
- Grip firmly and with both hands.
- Bring the load close to the body
- Keep your arms and elbows tucked in
- Keep the weight centered.
- Let your legs do the work. Push with your legs slowly
- Keep your back as straight and upright as possible.
- Move slowly, with small steps.
- Avoid twisting.
- Change direction with your feet, not your body.
- Unload slowly by bending your knees, not your back.
- Be careful that your fingers or toes are not beneath the object
Moving Cables, Disks, Pulleys, and Ropes
Do not touch (or guide with another object) moving objects. Do not allow your clothing to become entangled with moving objects. Stand clear of all objects that are under strain and may break.
Do not perform unfamiliar or non-routine tasks until properly planned. Proper planning includes analyzing possible consequences and recovery procedures.
All employees are required to take part in safety meetings.
Speed causes injuries and kills.
Stairways and Landings
Only use stairways, landings and elevated walkways that are properly constructed and have proper guardrails.
Throwing or Dropping
Throwing or dropping materials is prohibited unless every precaution is taken to eliminate all potential injury.
All unsafe practices and conditions must be immediately reported to supervisory personnel.
Work shall be suspended when weather conditions make continued working hazardous.
Warning Signs and Devices
Always heed all warning signs and devices.
Items like oily rags, spray cans, and other combustibles shall be removed outside daily and disposed of properly.
All objects that may cause punctures or cuts shall be immediately removed, bent, or otherwise protected in order to prevent injury.
Clean up and eliminate all hazards which may cause slipping.
Keep all areas where people may travel free from obstacles. This includes ladders, stairs, walkways, etc.
Employees shall keep workspaces orderly and clean at all times.
MEDICAL SERVICES & FIRST AID
- Apply direct pressure. Place a clean, folded cloth over the injured area and firmly apply pressure. If blood soaks through, do not remove it, add another layer.
- Elevate the injury above the heart if possible.
- If the blood flow does not slow – use pressure points (arteries)
- Last – ONLY IF ALL ELSE FAILS – Resort to a tourniquet
Immediately treat acid, caustic, and other types of burns by flushing with cold water. Do not remove material or clothing which is stuck to the burn area.
Do not touch electrical shock victims until they are free from electrical contact. Turn off the electric power or use a non-conducting object to remove the electrical contact from the victim.
First Aid Kits
First aid kits meeting OSHA requirements shall be available in all workplaces at all times. Safety training shall include the proper use of items contained in the kits and kit storage locations
First Aid Trained Person
When a medical facility is not reasonably accessible to a work site an individual with a valid first aid certificate must be available at the workplace.
Emergency Telephone Numbers
A list of emergency telephone numbers shall be kept at each Company workplace.
Injury and Accident Reporting
All injuries and accidents which cause damage must be reported on the Company First Report of Injury or Accident Report or both forms.
FIRE PREVENTION AND CONTROL
Use only those fluids which are made for cleaning. Flammable liquids shall not be used as cleaning agents.
Always check the Material Safety Data Sheet to see if a product is combustible. . Do not use combustible liquids, gases, or other flammable materials near heat nor any ignition source. Many combustible gases are heavier than air, and can travel along the ground a substantial distance to a source of ignition and then “flash-back”!
Combustible Rags and Waste
Discard all oily rags, waste, and similar combustible materials daily, or store them in metal containers with tight-fitting lids.
Fire Extinguishers and Types of Fires
Operable and current inspected fire extinguishers shall be provided at each workplace. Fire extinguishers are to be clearly marked, easily accessible and appropriate for the type of chemicals present.
The Hazard Communication Program describes which types of extinguishing media are to be used with various types of chemicals present in the workplace. You will find that information on the Material Safety Data Sheets.
In general, the following types of fires may be safely put out with the fire extinguishers noted:
- CLASS A – Wood, Paper, TrashWater or foam extinguishers
- CLASS B – flammable liquids, gas, oil, paints, greaseFoam, CO2 or dry chemical extinguishers
- CLASS C – electricalCO2 or dry chemical extinguishers
All flammable liquids are to be stored and used from OSHA-approved type safety containers. That would be metal cans with spring-closing covers and spark arresters.
Only Store flammable or combustible liquids in OSHA approved containers. Store all combustibles in a cool, well-ventilated space free from heat or ignition sources. Do not store more than 25 gallons of any flammable or combustible liquid in one room. Do not store flammable substances in or on a vehicle or other equipment unless it i designated for flammable storage.
Fire Fighting Equipment
Fire fighting equipment is to be located in conspicuous, readily accessible places. It is to be periodically inspected and maintained in operating condition as required by OSHA regulations. Fire fighting equipment shall be kept free of obstacles that delay or prevent access. Employees are to be trained on the proper utilization and location of Company fire fighting equipment.
All hand and power tools used at Company workplaces shall be maintained in a safe and serviceable condition and are to be inspected periodically by the responsible supervisor.
All tools designed for use with guards are to have the guards in place when in use.
Employees will use PPE for all tools that require PPE during use.
Damaged, Broken, or Defective Tools
Damaged, broken, or defective tools shall not be used to perform work activities. These tools must be reported to your supervisor and removed from the work area.
Only knowledgeable qualified operators are to operate power tools.
Only use the proper tools and equipment for the task you are assigned to do.
Striking of Hard Faced materials
Do not bang or strike two hardened surfaces together without using proper personal protective equipment.
All tools are to be kept in their proper storage place when not in use. Do not leave tools where they might present a tripping hazard, fall on somebody, or be stolen. Do not put sharp-edged tools where they cannot be seen or in your pockets.
